Robbers don't seem to be having much luck in Houston, TX lately!

Here's another robbery fail:

Houston homeowner shoots, kills, one of three men breaking into his car

A south Houston homeowner shot and killed one of three men he caught breaking into car early Sunday morning, according to KTRK.

Police say the homeowner saw the three men stealing from his car near Gulf Valley and Springtime. After the three refused to stop rummaging through his stuff the man reportedly went and got the gun. He opened fire after one of the suspects pulled a weapon on him. The three suspects then attempted to flee. The driver of the suspects’ getaway car was found dead behind the driver’s seat a few blocks away. A second suspect was later captured. The third is still at large, according to the story.

Unfortunately, in SC, deploying deadly force to protect property will get you locked up unless your life was in danger. At least in this story, the vehicle owner was met with deadly force and acted accordingly. At least in Texas, juries have been known to side with the property owner in burglary cases even when no weapon was found on the perps. We can't really say that yet for SC, so be wise to how you use your sidearm in places where Castle Doctrine will not cover you. Current SC law says you can't be involved in escalating a situation that leads up to deploying deadly force. SC may view the homeowner going back into his home to get a gun and coming back out as escalating the situation. At least Texas gets it.

There are always stories like that on the news from around the state. I have never heard of anyone getting charged. Google Joe Horne that was a pretty popular shooting....no charges filed.
