Got a ticket on the river this weekend for "making wake" in the no wake zone on the tail race. The officer name was V. Peele.

He said he saw me change speed twice in front of Gilligans. I guess he didn't realize a jet ski needs a little throttle to steer and avoid other boats while going against current. I didn't even have any white water behind the ski. I wasn't going to argue though.

And good luck. Memorial day weekend is a good revenue weekend for the counties. Not an easy task to get out of anything officers write on the water this weekend.

Mt. Pleasant, Goose Creek and Hanahan are very aggressive in prosecuting everything, so a blanket statement that a jury trial request will force a dismissal is incorrect.

I don't know how aggressive a reserve BCSD would be, but if he has already gotten his ass on his shoulders because someone reached out to him I wouldn't be so sure that he would drop it because a jury trial is demanded. Remember, he is a reserve so he is probably more gung ho than a seasoned vet.

You are not required to show up to court for that ticket. You can pay it through the mail but I would not advise it unless you send it certified mail, return receipt requested.

If you go to Court you have 3 options:

1) Plead No Contest and pay the fine;
2) Plead Not Guilty and have a bench trial with the judge; or
3) Request a Jury Trial and have to go back to Court several times before they either try the case or dismiss the ticket.

I suggest #1.

oldskoolstang
05-31-2012, 05:15 PM
I don't know how it is there, but here just because you go to court there are extra fees (court costs). I'd just pay the ticket with a certified check and have them mail me a receipt.

I've had lots of tickets and have learned the hard way that sometimes it's just easier to let some things go, despite how bad it may piss you off.

I spoke from personal experience, with Hanahan not immediately throwing out a case just because you ask for a jury trial. I also know that in Hanahan there's some 90 year old man that stands up before court starts and asks "if anyone wants to plead guilty, bring me your ticket for a possible reduction in points and fines", so they might to this in Berkley County Court as well? I know that I lived in SC for over 10 years and never got a ticket, I moved to Hanahan, got pulled over 3 times and recieved two tickets within a month.

That just increases your chances of being forced to make donations to the government coffers. How else do you think they are going to pay for all that holiday weekend overtime?

All im going to say is that if you are going to try and fight the system you need to be damn sure you know exactly what your talking about before you do it, I hear a lot of people say some off the wall bullshit that they think they can do to get out of stuff and to be honest people should stop listening to the crap their friends tell them. Just as an example, you could drive a brand new car straight from the dealership on to base ( I know on base and out in town is a little different but not as much as you think) and i could pull you over and i guarantee you that i could find something on that car to give you a ticket for, and to be honest the more you try to fight it and tell me what i can and cant do the more i will find just to prove you wrong. Kind of off topic but my point is that you really need to pick your battles and dont just try to fight something just for the sake of fighting it....And this is just a general statement im not saying thats what your trying to do matt lol

OK, if very little money makes it back to the issuing department, then what's the reasoning behind the vast increase of citations on holiday weekends for "trivial" things like a minor wake from a jet ski? Is it brownie points for the cop, or is it a quota thing imposed by the higher up brass? I have no problem with increased police presence on holiday weekends to keep the drunk and reckless in check, but if there are no active drunks to deal with at a given time, then why the increased activity in revenue collection for trivial things that wouldn't get a second look outside of a holiday?

It's not that I am against cops, I just don't trust the modern day system of authority as a whole. Just a couple of bad apples ruin the whole bunch. I know quite a few cops on a first name basis and they are very decent people and don't treat their badges like a crown. These people I have the utmost respect for because I get the same level of respect back in return.

I'm sorry... what did you say? I was too busy looking at your avatar. :)

In all seriousness, and I can only speak for my department, but there is no quota. We never get "brownie" points for writing citations or making arrests. It comes with the job. Maybe look of it as more police presence with less to do, so more chances of getting stopped for something you wouldn't normally. I'd also like to see these trivial citations you speak of? Show me a proportionate number of "trivial" citations on holiday weekends. Where are you basing this opinion? In Matt's case, wrong place wrong time. Sometimes a crack down on little things keeps people as a whole "in check." Especially during busy events or holidays. For example... Myrtle Beach biker weeks. They have zero tolerance, and people know this. Therefore, people are more apt to behave.

Truth be known. One of the reasons they were probably in that area was 1- It was a holiday and all the idiots AKA (people like you) are out there doing stupid crap. 2- My wife(a BCSO Diver) who uses that area for trainig and has almost gottten ran over by Morons like you has expressed a concern in the lack of attention paid to the NO Wake Zone. Now any more comments directed at me about this is fine Joe, I could give 2 shits less about your views or anything else you have to say. But that area is used by more than just boaters, not that they would have been training during that time frame. But, I am just going out on a limb and guessing about all this. Please STFU, harry You only come on these cop threads to irritate people with your nutswinging.

You are not a cop and since you have "not idea about anything Law Enforcement related" stfu. You have NO idea what went on last weekend. None of us were doing anything remotely stupid. Matt gently moved his ski away from hitting a boat and got ticketed for doing something more than idling. There was no wake. It was bs. And I never said the "no wake zone" was unnecessary. The cop was a dick and his actions are the reason many people don't like cops.

If a boat rolled through and ran someone over there would be a thread called "where were the cops? At the donut shop?" Damned if they do and damned if they don't.

Or if the wake came off the back of a dnr or bcso boat, ya'lls opinion of wake would be different.

Maybe the cops would have more time to fight "real crime" if they didn't have to answer calls for all of you who dislike them. So all the haters please don't ever take up any of their time.

I guess everyone thinks this is a "no harm, no foul" situation, so the officer is an asshole. But I remember not to long ago Matt calling in and reporting an officer for running a stop light even though that was a similar "no harm no foul" situation. Funny the double standards.

Exact opposite experience. They caught the guy who broke into my neighbors house a few years ago on the 4th of July. After I called it in; they were on scene within 90 seconds. Got him as he was fleeing.

Most of this is painfull to read. Sorry it happened to ya Matt. If someone reached out to the officer and he said no then I'd just go in and ask for the reduction. It could get dropped if you ask for a jury trial but the time you spend up there will suck.

I have been an officer for four years and have not met an officer that I know was dirty. I have met a ton of assholes but no one that would "frame" anyone. On this board I bet the problems have been with traffic cops and they do tend to be a little more uptight.

Seeing as we have a few LEOs on the forum here from various agencies, how would you LEOs rate your decent cop vs. asshole cop ratios within your particular agencies? It would be nice to know what percentage of "uptight" power tripping ones it takes to give the decent ones a bad name.

Just got back from court. The officer seemed pissed that people were calling him for me. It was the first thing he mentioned to me in the hall. Anyhow, I ended up pleading not guilty and had a bench trial that ended with a $50 fine.

I thought I had it nailed down and I though the judge was about to drop the fine until the officer claimed I came out of the locks on plane. Total B.S. There was nothing about that mentioned on the river, the ticket was not for such violation, and it did not happen. I feel like he used that as leverage.

However, I am happy with the results.
